Tu Hai Meri Kiran Release पर रोक: Sonakshi Sinha की Film के लिए Bombay High Court ने रखी ₹8.85 Crore की शर्त
Tu Hai Meri Kiran Latest News: Sonakshi Sinha और Zaheer Iqbal की upcoming romantic thriller Tu Hai Meri Kiran की theatrical release कानूनी विवाद के कारण मुश्किल में पड़ गई है। Bombay High Court ने फिल्म के commercial release और exploitation पर तब तक रोक लगाने का निर्देश दिया है, जब तक producer Echelon Productions co-producer AND Movie Products LLP के ₹8.85 crore investment को 15% annual interest के साथ secure नहीं कर देता।
फिल्म की release date 23 October 2026 तय की गई थी। ऐसे में court का यह order release से कुछ दिन पहले आया है, जिससे theatrical distribution और audience plans पर असर पड़ सकता है। हालांकि, court ने फिल्म को हमेशा के लिए रोकने का आदेश नहीं दिया है। निर्धारित financial security जमा होने और बाकी directions का पालन किए जाने पर फिल्म की release आगे बढ़ सकती है।
यह आदेश 19 October 2026 को Justice Amit Borkar ने AND Movie Products LLP की petition पर सुनाया। इस मामले में court ने co-producer के financial investment और contractual rights को सुरक्षित रखने के लिए interim relief दिया है।
Tu Hai Meri Kiran Release पर Court ने क्या कहा?
Bombay High Court के अनुसार, Echelon Productions को ₹8.85 crore जमा करने होंगे। इसके साथ 15% annual interest भी देना होगा, जिसकी गणना co-producer द्वारा अलग-अलग तारीखों पर किए गए investments के आधार पर की जाएगी। Court ने इसके लिए तीन working days का समय दिया था।
यह रकम co-producer को तुरंत भुगतान करने के लिए नहीं, बल्कि उसके disputed financial claim को सुरक्षित रखने के लिए जमा कराई जानी है। Court या arbitral tribunal के आदेश के बिना यह security amount जारी नहीं किया जा सकता।
Court ने यह संतुलन बनाने की कोशिश की कि एक तरफ film production में लगे समय, मेहनत और पैसे को नजरअंदाज न किया जाए, वहीं दूसरी तरफ co-producer के investment और contractual rights भी सुरक्षित रहें।
इसलिए, जब तक financial security जमा नहीं होती, फिल्म का theatrical, satellite, digital, OTT, music या किसी अन्य माध्यम से commercial exploitation नहीं किया जा सकता। Security जमा होने के बाद भी producers को court की बाकी directions और co-production agreement का पालन करना होगा।
₹8.85 Crore का Dispute कैसे शुरू हुआ?
इस विवाद की जड़ 27 March 2024 को हुआ co-production agreement है। AND Movie Products LLP और Echelon Productions ने फिल्म के production और exploitation के लिए agreement किया था। दोनों पक्षों को ₹7.50 crore plus GST का contribution देना था।
AND Movie Products LLP के अनुसार, उसने March 2024 से January 2025 के बीच कुल ₹8.85 crore invest किए, लेकिन agreement के मुताबिक रकम वापस नहीं मिली।
Agreement की Clause 5.3 के अनुसार, investment की repayment 13 months के भीतर या फिल्म की पहली release से तीन सप्ताह पहले—इनमें से जो तारीख पहले आती—होनी थी। Court ने prima facie माना कि repayment की deadline 27 April 2025 को समाप्त हो गई थी।
मामला तब और गंभीर हुआ, जब 1 January 2026 को जारी ₹7.50 crore का cheque dishonour हो गया। इसके बाद co-producer ने legal notice भेजा और फिल्म की release date घोषित होने पर Bombay High Court का रुख किया।
यह ध्यान रखना जरूरी है कि court के ये findings interim relief के उद्देश्य से हैं। Final financial liability और parties के contractual rights का फैसला arbitration में होना बाकी है।
Film की Promotion से Co-Producer के Rights खत्म नहीं हुए
Producers की ओर से यह तर्क दिया गया था कि co-producer ने फिल्म के Instagram promotions में हिस्सा लिया था और उसे release date की जानकारी थी। लेकिन court ने promotional activities में भाग लेने को repayment rights छोड़ने या बिना consent third-party agreements करने की अनुमति मानने से इनकार किया।
Court ने स्पष्ट किया कि किसी फिल्म का promotion करना अपने आप में यह साबित नहीं करता कि co-producer ने अपने financial claims या contractual protections को छोड़ दिया है।
इसका असर फिल्म के commercial agreements पर भी पड़ सकता है। Court ने निर्देश दिया कि Echelon Productions को फिल्म के exploitation से जुड़े existing और proposed agreements, offers, term sheets तथा अन्य arrangements का विवरण affidavit के माध्यम से देना होगा।
इसके अलावा, co-producer को relevant exploitation agreements में confirming party बनाने और agreement के अनुसार उसकी consent लेने के निर्देश भी दिए गए हैं।
Producers को Revenue और Credits पर भी निर्देश
Bombay High Court ने केवल investment security तक अपना आदेश सीमित नहीं रखा। Film से मिलने वाले revenue को एक अलग designated account में जमा करने और उसका नियमित हिसाब उपलब्ध कराने के निर्देश भी दिए गए हैं।
Court ने production house को account details disclose करने और फिल्म से जुड़े commercial arrangements की जानकारी देने को कहा। Publicity material में agreed producer credits या logo की शर्तों का पालन नहीं होने पर संबंधित सामग्री को 48 घंटे के भीतर सुधारने या हटाने का निर्देश भी दिया गया।
इन directions का उद्देश्य यह सुनिश्चित करना है कि फिल्म की release या commercial exploitation के दौरान co-producer के contractual rights प्रभावित न हों।
क्या Tu Hai Meri Kiran 23 October को Theatres में रिलीज होगी?
फिल्म की announced theatrical release date 23 October 2026 है, लेकिन इसका commercial release court की financial security और बाकी conditions के पालन पर निर्भर करता है।
22 October 2026 तक उपलब्ध public reports में ₹8.85 crore की required security जमा किए जाने की स्वतंत्र पुष्टि नहीं मिली। इसलिए फिल्म की release को निश्चित रूप से confirmed या cancelled बताना जल्दबाजी होगी। दर्शकों को theatre listings और makers की official announcements check करनी चाहिए।
